These Terms of Service ("Terms") govern your access to and use of the Cozy Clickers website at cozyclickers.com, our applications (including the Cozy Top Generator at cozytop.cozyclickers.com), and our 3D models and files (together, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
The Services are operated by Suri and Allen Huang, trading as "Cozy Clickers" ("we", "us", "our"), a small independent 3D design studio. You can reach us any time at hello@cozyclickers.com.
You must be at least 16 years old, or the age of digital consent in your country, to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or guardian.
We grant you a limited, non-exclusive, non-transferable license to use our Models as follows, depending on where you obtained them:
In all cases you may not: resell, share, sub-license, or redistribute the digital Model files themselves; claim authorship of our designs; or use our designs in a way that is unlawful, misleading, or harmful to the Cozy Clickers brand. All rights not expressly granted are reserved.
Access to certain Apps is limited to Patrons and is subject to your maintaining an active membership. We provide the Apps on an "as available" basis and may add, change, suspend, or discontinue any App or feature at any time. We aim to keep generated files print-ready, but results depend on your printer, materials, and settings.
You keep ownership of Your Content. By uploading or creating Your Content, you confirm that:
You grant us a limited license to process and transform Your Content solely to provide the App's functionality to you (for example, to generate your customised file and, where applicable, save it to your account so you can re-download it). We do not claim ownership of Your Content and do not use it to create products we sell. The underlying base designs, geometry, and software that power the Apps remain our property, and the file you generate combines our base with Your Content for your own use under the license in Section 5.
The Services, including our Models, base designs, software, brand name, logo, text, and images, are owned by us or our licensors and are protected by intellectual property laws. Except for the limited licenses described above, nothing in these Terms transfers any of those rights to you.
Memberships are offered and billed through Patreon, not directly by us. Your membership, billing, renewals, and cancellations are governed by Patreon's own terms in addition to these Terms. Tier names, perks, and prices may change; we will reflect material changes on our site and/or Patreon page.
You agree not to: use the Services for any unlawful purpose; reverse-engineer, scrape, or attempt to extract our source files or underlying Models other than as expressly permitted; resell or share access to Patron-only Apps; interfere with or disrupt the Services; or use automated systems to access the Services in a way that harms them or other users.
The Services, Models, and Apps are provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or fit for a particular purpose. 3D printing carries inherent risks — printer operation, heat, moving parts, and materials can cause injury or damage, and printed results vary. You are responsible for safe printing and for supervising any minors or others who use printed items.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill, arising from your use of the Services. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law — including, for consumers in the European Union, liability for death or personal injury caused by our negligence, fraud, or any mandatory statutory rights.
You agree to indemnify and hold us harmless from claims, damages, and reasonable costs arising out of your misuse of the Services, your breach of these Terms, or Your Content infringing the rights of a third party.
The Services link to and rely on third parties such as Patreon, MakerWorld, and Google. We are not responsible for their content, products, or practices, and your use of them is governed by their own terms. Our handling of your data is described in our Privacy Policy.
You may stop using the Services at any time. We may suspend or end your access to all or part of the Services if you breach these Terms or use the Services in a way that may cause harm or legal liability. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and significant changes will be reflected on this page. Your continued use of the Services after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of Portugal, without regard to its conflict-of-law rules, and the courts of Portugal will have jurisdiction over any disputes. If you are a consumer resident in the European Union, you also keep the benefit of any mandatory consumer-protection rights of the country where you live, and nothing in these Terms removes those rights. You may also have access to the EU's Online Dispute Resolution platform.
